ARTICLE I. CITY CLERK

 

 

SECTION 115.010: SELECTION AND TERM OF CITY CLERK

 

The City Clerk shall be elected by a majority of the Board of Aldermen to serve for an unspecified term at the will of the Board of Aldermen.  (Ord. No. 467 §2, 6-27-95)

 

 

SECTION 115.015: ASSISTANT CITY CLERK

 

There is hereby established the office of Assistant City Clerk for the City of Pasadena Hills, Missouri.  The Mayor, with consent and approval of a majority of the members of the Board of

Aldermen, may appoint a qualified person to the office of Assistant City Clerk, to serve at the pleasure of the Mayor and Board of Aldermen.  The Assistant City Clerk shall perform the duties of the City Clerk in the Clerk's absence and perform such additional duties as may be determined by the Mayor, Board of Aldermen or City Clerk as the efficient service of the City may require.  Compensation for performing the duties of the office of Assistant City Clerk shall be fixed by ordinance from time to time.  (Ord. SECTION 115.020: HOURS AND AUTHORIZATION OF COMPENSATION

 

The City Clerk shall staff the City Hall offices during the hours designated by the Mayor and Board of Aldermen from time to time.  Compensation for the City Clerk shall be established by ordinance from time to time.  (Ord. No. 467 §3, 6-27-95)

 

 

SECTION 115.030: QUALIFICATIONS

 

No person shall be eligible for the office of City Clerk who, at the time of election by the Board, is in arrears for any unpaid City taxes for forfeiture or defalcation in office.

SECTION 115.040: DUTIES

 

The City Clerk's duties shall include the following:

 

1.     To act as secretary of the meetings and hearings of the Board of Aldermen, including any special meetings that may be held; to faithfully and accurately keep a journal and minutes of the proceedings of the Board of Aldermen; to distribute an agenda and copies of the minutes of previous meetings to the Mayor, Board of Aldermen and all City Officials prior to the next regular meeting of the Board of Aldermen; to prepare and post all notices of meetings and hearings; and to maintain and respond to all correspondence directed to the City.

 

2.     To safely and properly keep all records and papers belonging to the City that may be entrusted to the Clerk's care; to be the general accountant of the City and account to the City Treasurer for all funds to the credit of the City which shall come into the Clerk's care and possession; to be the custodian of all records of the City, including, but not limited to, the minutes of all meetings, ordinances, contracts, blue prints, cash journal, paid vouchers and payroll records.

 

3.     To see that the offices of the City Hall are open and staffed during the hours established by the Mayor and Board of Aldermen from time to time and that matters presented to the said office by residents, officials and members of the public are attended to efficiently.

 

4.     To administer oaths; to keep the City Seal and authenticate records and documents as may be required.

 

5.     To cooperate with the City Treasurer in procuring a lawful and proper assessment of property within the City for purposes of providing revenue for the City; to procure from the Clerk of St. Louis County a certified abstract from the County assessment books, as corrected by the County Board of Equalization of all property within the City made taxable by law, which abstract shall by the Board of Aldermen be accepted, taken and considered as the lawful and proper assessment on which to levy and collect the taxes of the City.

 

6.     To be the "Violations Clerk" for the Traffic Violations Bureau for the Municipal Court of the City and Deputy Clerk for the said court; to accept appearances, waivers of trial, pleas of guilty and payment of fines and costs in traffic offenses in accordance with the lawfully promulgated schedule of fines; to keep a record of all pleas of guilty and waivers of trial, payments of fines and court costs; and to forward to the Director of Revenue all records of conviction in accordance with the laws of the State of Missouri presently in effect and as may be amended from time to time.

 

7.     To perform such other official duties as the Clerk may, from time to time, be requested and directed to perform by the Municipal Judge, Mayor or Board of Aldermen.

SECTION 115.050: HOLIDAYS

 

The offices of the City Hall shall be closed, and the City Clerk shall receive holiday pay at the regular rate of compensation provided for the office, on the following holidays:  New Year's Day, Dr. Martin Luther King Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day.  If any listed holiday shall fall on a Saturday or Sunday, it shall be celebrated and recognized on the preceding Friday or following Monday, respectively.  (Ord. SECTION 115.060: VACATION

 

After one (1) year of service, the City Clerk shall have earned and be entitled to five (5) days of paid vacation.  After two (2) years of service, and after each year of service thereafter, the City Clerk shall have earned ten (10) days of paid vacation.  (Ord. No. 467 §7, 6-27-95)

 

 

SECTION 115.070: SICK LEAVE

 

The City Clerk shall be entitled to paid sick leave at the rate of five (5) days per year, effective upon the first (1st) anniversary date of employment.  Sick leave may not be accumulated from year to year.  If the City Clerk does not use any sick leave in a year, he/she will be eligible to receive two (2) days of paid personal leave during the following twelve (12) month period.

SECTION 115.080: BOND

 

Within fifteen (15) days after election, and before entering upon the discharge of the above-described duties of office, the City Clerk shall give bond to the City in the sum of ten thousand dollars ($10,000.00) conditioned upon the faithful performance of said duties and that the said City Clerk will pay over all monies belonging to the City, as provided by law, that may come into the City Clerk's hands.  (Ord. ARTICLE II.  CITY TREASURER

 

 

SECTION 115.090: SELECTION AND TERM OF CITY TREASURER

 

Following the Municipal election of each year, the Mayor with the approval of the majority of the Board of Aldermen shall appoint some suitable person as Treasurer, who shall hold office at the pleasure of the Mayor and Board of Aldermen and until a successor is named.

SECTION 115.100: AUTHORIZATION OF COMPENSATION

 

The Treasurer shall receive compensation as set by the Board of Aldermen by ordinance from time to time.

 

 

SECTION 115.110: DUTIES

 

A.    The Treasurer shall receive and safely keep all monies, warrants, books, bonds and obligations entrusted to his/her care, and shall pay over all monies, bonds and other obligations of the City on warrants or orders, duly drawn, passed or ordered by the Board of Aldermen, and signed by the Mayor and attested by the City Clerk, and having the Seal of the City affixed thereto, and not otherwise; and shall perform such other duties as may be required of him/her by ordinance.

 

B.    The Treasurer shall report to the Board of Aldermen, on or before the first (1st) day of July in each year, the amount of receipts and expenditures of the Treasury, the amount of money on hand, and the amount of bonds falling due, if any, for the redemption of which provision must be made; also, the amount of interest to be paid during the next fiscal year.

 

C.    The Treasurer shall cooperate with the Mayor in providing information necessary for the semi-annual statements to be published in accord with Chapter 140.

 

D.    The Treasurer shall be assigned the title of Budget Officer for the City of Pasadena Hills and as such shall be responsible for the duties described in Chapter 67 of the Revised Statutes of Missouri.  (Ord. No. 463 §4, 2-14-95)

 

 

SECTION 115.120: BOND

 

Within fifteen (15) days after appointment and before entering upon the discharge of the above-described duties of office, the Treasurer shall give bond to the City in the sum of ten thousand dollars ($10,000.00) conditioned upon the faithful performance of said duties and that the said Treasurer will pay over all monies belonging to the City, as provided by law, that may come into the Treasurer's hands.  The cost of the Bond, if any, is to be paid by the City.

ARTICLE III.  CITY ATTORNEY

 

 

SECTION 115.130: CITY ATTORNEYPOWERS AND DUTIES

 

A.    The Mayor, with the approval of the majority of the members of the Board of Aldermen, shall appoint some qualified individual as Prosecuting and City Attorney.

 

B.    As City Attorney, counsel shall advise the Board of Aldermen and Mayor on all legal matters submitted by them on Municipal affairs and their offices, shall attend or be represented at all Board meetings when requested by the Mayor or Board of Aldermen, and shall perform such other legal services as the Board of Aldermen or Mayor may further direct.

 

C.    As Prosecuting Attorney, counsel shall represent the City as its prosecutor in the Municipal Court of the City and before the Circuit Court of the County of St. Louis on any appeals, and shall perform each of the legal services incidental to the prosecution of violations of ordinances of the City.

 

D.    Nothing herein shall be construed as preventing the Board of Aldermen or Mayor, with the consent of the majority of the Board of Aldermen, from employing Special Counsel.

ARTICLE IV.  CITY ENGINEER

 

 

SECTION 115.140: CITY ENGINEERAPPOINTMENTQUALIFICATIONSDUTIES

COMPENSATION

 

A.    The Mayor, with the approval of a majority of the members of the Board of Aldermen, shall have the power to appoint a City Engineer, who is otherwise qualified to hold said office as specified herein.

 

B.    The City Engineer shall be duly licensed by the State of Missouri to practice the profession of engineering or architecture.

 

C.    The City Engineer shall perform the following general services for the City:

 

1.     To attend all meetings of the Board of Aldermen, Board of Adjustment, and Planning and Zoning Commission when requested by the Mayor or a majority of the requesting Boards;

 

2.     To provide advisory services to the Mayor, Board of Aldermen, Board of Adjustment and Planning and Zoning Commission, including, but not limited to, the preparation of engineering estimates, scope of services criteria, bids and specifications, legal descriptions or other engineering or survey documents when requested by the Mayor or a majority of the requesting Boards;

 

3.     To maintain and update all zoning changes and general information with regard to the City's Zoning Map and keep all such records current.

 

D.    The City Engineer shall be compensated on an hourly basis for professional engineering services rendered to the City as specified in Subsection (C).  The City Engineer shall be an independent contractor with the City and shall be compensated per billable hour, plus expenses, in accordance with a written contract for professional engineering and architectural services, to be entered into by the City with the City Engineer.  (Ord. ARTICLE V.  STREET COMMISSIONER

 

 

SECTION 115.150: STREET COMMISSIONERAPPOINTMENTRESPONSIBILITIES AND

DUTIES

 

A.    The Mayor, with the approval of the majority of the members of the Board of Aldermen, may appoint some suitable person as City Street Commissioner, who shall act as such until the annual election of Aldermen or until a successor is appointed and qualified who shall serve at the pleasure of the Mayor and Board of Aldermen.

 

B.    The Street Commissioner shall be responsible for the making of recommendations to the Board of Aldermen for the maintenance, repair and reconstruction of the streets and public sidewalks and sewers within the City; for the supervision of performance of any maintenance contract for City property; for the preparation and presentation of a regular report to the Board of Aldermen on the performance of maintenance contracts; and for such other duties as may be directed to be performed by the Board of Aldermen.

 

C.    The Street Commissioner may, from time to time, make written recommendations to the Mayor for projects which he/she feels are necessary or desirable, but no action shall be taken on such recommendations until they have been formally approved by the Board of Aldermen.

SECTION 115.160: AUTHORIZATION OF STREET COMMISSIONERCONTRACT FOR

EMERGENCY STREET AND LIGHT REPAIRSPROCEDURE

 

A.    In the event of any emergency, the Street Commissioner of the City of Pasadena Hills is hereby authorized to contract with a bonded and licensed contractor to make emergency repairs to the streets and/or street lights within the City of Pasadena Hills, without obtaining prior approval of the Board of Aldermen, subject to the following limitations:

 

1.     The estimated costs of repairs shall not exceed three thousand dollars ($3,000.00); and

 

2.     The Street Commissioner shall contact the City Treasurer to determine that there are sufficient funds in the City's account and budget to pay for the costs of the emergency repairs.

 

B.    In the event the estimated costs of repairs and/or after work has commenced it is determined that the costs of completing the repairs will exceed three thousand dollars ($3,000.00) the Street Commissioner shall report this fact to the Mayor who shall, thereafter, convene a special meeting of the Board of Aldermen to consider whether to let the repairs for bid and/or authorize the contractor to proceed with the completion of the repairs.  In the event work has been started but not completed, the Street Commissioner shall issue an order directing the contractor to cease and desist further work and advise the contractor that if he/she proceeds, it will be at his/her risk of non-payment.

 

C.    The Street Commissioner shall report to the Board of Aldermen and the Treasurer, at each regular meeting, all emergency repairs contracted for during the thirty (30) days immediately proceeding the regular meeting of the Board of Aldermen.  (Ord. No. 368 §§13, 1988)

 

 

ARTICLE VI.  REMOVAL FROM OFFICE

 

 

SECTION 115.170: REMOVAL OF OFFICERS

 

The Mayor may, with the consent of a majority of all the members elected to the Board of Aldermen, remove from office, for cause shown, any elective officer of the City, such officer being first given opportunity, together with his/her witnesses, to be heard before the Board of Aldermen sitting as a board of impeachment.  Any elective officer, including the Mayor, may in like manner, for cause shown, be removed from office by a two-thirds (2/3) vote of all members elected to the Board of Aldermen, independently of the Mayor's approval or recommendation.  The Mayor may, with the consent of a majority of all the members elected to the Board of Aldermen, remove from office any appointive officer of the City at will, and any such appointive officer may be so removed by a two-thirds (2/3) vote of all the members elected to the Board of Aldermen, independently of the Mayor's approval or recommendation.  The Board of Aldermen may pass ordinances regulating the manner of impeachments and removals.
